4 Alberta doctors launch lawsuit over mandatory COVID-19 vaccine policy

Plaintiffs allege vaccination policy ‘amounts to assault’

Four Alberta doctors are suing the provincial health authority and its president over its mandatory workplace COVID-19 vaccination policy.

The physicians filed a statement of claim last Friday in the Calgary Courts Centre.

The plaintiffs — Calgary pediatric neurologist Dr. Eric T. Payne, Calgary anesthesiologist Dr. Joanna J. Moser, Ponoka family physician Dr. Gregory Keen-Wai Chan and Sexsmith family physician Dr. David Loewen — allege that, by requiring them to get vaccinated against COVID-19, Alberta Health Services (AHS) is engaging in a conspiracy to commit assault.

“Any medical procedure performed on a patient without their informed consent amounts to assault,” the statement of claim says.

The vaccination requirement applies to all workers at AHS, Alberta Precision Labs, Carewest, CapitalCare and Covenant Health workers, and members of medical and midwifery staffs, among others.

The lawsuit, filed on the doctors’ behalf by Calgary lawyer Jeffery Rath, also alleges that the mandatory vaccination policy amounts to “constructive dismissal” because it alters the plaintiffs’ contracts on threat of termination or unpaid suspension.

AHS ‘confident’ in policy

The statement of claim goes on to allege that the vaccine policy breaches confidentiality, since “the minute a physician is placed on unpaid leave, their status is immediately apparent.”

The plaintiffs will argue that this inflicts damage to their professional reputations and causes psychological harm.

The suit also alleges the AHS policy violates right to security of the person guaranteed under Section 7 of the Charter of Rights and Freedoms.

Rath said he will file an application for an injunction on Monday to force AHS to put the policy on hold until the lawsuit is heard in court.

A spokesperson for AHS, James Wood, told CBC News they have yet to receive any court documents related to the lawsuit.

He said 94 per cent of full-time and part-time AHS employees — and 94 per cent of AHS physicians — have already abided by the policy and submitted proof of having two doses of COVID-19 vaccine.

The plaintiffs in the lawsuit account for less than 0.1 per cent of the 9,000 physicians working in Alberta’s integrated health-care system, he said.

“AHS is confident in the validity of the mandatory immunization policy, which is an important tool to ensure the safety of our staff, physicians and patients,” Wood said.

Last week, AHS extended its deadline for all workers to be vaccinated against COVID-19 by one month, to Nov. 30.

To date, 61 employees have resigned their positions specifically because of the vaccination policy. That includes 31 staffers in clinical roles, 11 of whom are registered nurses.

The lawsuit alleges that AHS president Dr. Verna Yiu, Alberta Premier Jason Kenney and other government officials, have made “false statements” that the “unvaccinated are to blame for the pandemic and hospital overcrowding.”

On Monday, there were 821 COVID patients in Alberta hospitals.

Dr. Deena Hinshaw, Alberta’s chief medical officer of health, tweeted last week that, from June 1 to Oct. 20, 87 per cent of ICU patients were unvaccinated.

Hamilton-Wentworth District School Board removed their coercive vaccine mandate, saving the livelihoods of many school board staff who chose not to vaccinate or disclose their status, sparing them of further life-altering stress.

“At the Hamilton-Wentworth District School Board, roughly 93 per cent of staff are fully vaccinated. Shawn McKillop, the board’s spokesman, said on Tuesday the board has removed a requirement that employees be fully vaccinated by Nov. 30. He said that it was a “result of the advice from experts and employee management groups.” Instead, unvaccinated staff will have to undergo rapid testing twice a week, he said.”

The FDA’s Vaccines and Related Biological Products Advisory Committee is holding a virtual meeting Tuesday October 26 to discuss authorizing a Pfizer-BioNTech Coronavirus vaccine for children between the ages of 5 to 11 years old.

This committee has a lot of sway with the FDA and their findings will be relevant, considering the Biden administration is getting ready to ship vaccines to elementary schools and California has already mandated the vaccine for schoolchildren pending federal authorization.

But the meeting roster shows that numerous members of the committee and temporary voting members have worked for Pfizer or have major connections to Pfizer.

Members include a former vice president of Pfizer Vaccines, a recent Pfizer consultant, a recent Pfizer research grant recipient, a man who mentored a current top Pfizer vaccine executive, a man who runs a center that gives out Pfizer vaccines, the chair of a Pfizer data group, a guy who was proudly photographed taking a Pfizer vaccine, and numerous people who are already on the record supporting Coronavirus vaccines for children. Meanwhile, recent FDA Commissioner Scott Gottlieb is on Pfizer’s board of directors.

Acting Chair Arnold S. Monto was a paid Pfizer consultant as recently as 2018.

Committee member Archana Chatterjee worked on a research project related to vaccines for infants between 2018-2020, and the research project was sponsored by Pfizer.

Myron Levine has mentored some U.S. post-doctoral fellows, and one of his proteges happens to be Raphael Simon, the senior director of vaccine research and development at Pfizer.

James Hildreth, temporary voting member, made a financial interest disclosure for this meeting in which he disclosed more than $1.5 million in relevant financial interests, including his work as president of Meharry Medical College, whichadministers Pfizer Coronavirus vaccines.

Geeta K. Swamy is listed as the chair of the “Independent Data Monitoring Committee for the Pfizer Group B Streptococcus Vaccine Program,” a committee sponsored by Pfizer. Duke University states that “Dr. Swamy serves as a co-investigator for the Pfizer COVID-19 vaccine trial.”

Gregg Sylvester previously served as a vice president for Pfizer Vaccines, where he launched Pfizer vaccines including one for children.

Among the meeting’s “temporary voting members,” Ofer Levy, Boston Children’s Hospital, is for the Pfizer vaccine for children, Eric Rubin is pro-vaccine for children, Jay Portnoy supports authorizing Coronavirus vaccines for kids, and Melinda Wharton complained over the summer about how orders for the CDC’s “Vaccines For Children” program dropped.

FDANews stated last December: “FDA advisory committee members in the past have frequently been the target of heavy politicking by industry representatives of whatever drug they were considering for a recommendation at in-person meetings. That process has been somewhat altered by the fact that during COVID-19, meetings are being held virtually. But it’s likely that behind-the-scenes pressuring still goes on. The industry defends the attempts to influence committee members as simply efforts to best present their case.”

In short, a staggering conflict of interest…
